1. Introduction
Welcome to CommonsInterface ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at commonsinterface.site (the "Service") operated by CommonsInterface.
By reserving a charter or using our Service, you consent to be abide by these Terms. If you do not agree with any part of these terms, you should refrain from using the Service.
2. Service Overview
CommonsInterface offers high-end yacht charter services, which include, but are not limited to:
- Daily yacht charters
- Sundown sailings
- Business retreats
- Exclusive events
- Extended charters
Availability of all services is contingent on scheduling and weather conditions. We maintain the right to change or cease services without prior notification.
3. Booking and Reservations
3.1 Reservation Procedure
When reserving a charter, you must:
- Be 18 years of age or older
- Provide truthful and complete details
- Remit the necessary deposit as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is only confirmed following the acceptance of your payment and our written acknowledgement. We reserve the exclusive right to decline service to anyone at our discretion.
3.3 Charter Availability
Charters are subject to the availability of vessels and favorable weather conditions. We will endeavor to accommodate your chosen dates and times to the best of our ability.
4. Payment Terms
4.1 Costs
All costs are presented in € and include relevant taxes unless specified otherwise. Prices may change without previous notice.
4.2 Schedule for Payments
- Initial Deposit: 50% of the complete charter fee due at the time of reservation
- Final Payment: Due 48 hours in advance of the charter start date
- Additional fees (if applicable): Payable upon conclusion of the charter
4.3 Accepted Payment Methods
Major credit cards, electronic bank transfers, and bank-certified drafts are accepted methods of payment. Our payment processes are secured and encrypted.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Complete refund minus transaction fees
- Between 24-72 hours prior to departure: 50% refund
- Less than 24 hours before departure: No refund offered
5.2 Weather Cancellations
If unsafe weather conditions are observed by our captain, we commit to:
- Rescheduling your charter at no extra charge to an alternative date
- Issuing a full refund in case rescheduling is not feasible
5.3 Vessel Malfunctions
Should there be technical issues with the yacht assigned to you, we will attempt to provide an equivalent substitute. If this is not possible, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Rules
All guests must:
- Adhere to all instructions from the crew
- Utilize any safety gear when deemed necessary
- Reveal any health conditions that could affect their safety
- Stay within specified areas on the yacht
6.2 Forbidden Objects
Certain items are not allowed on board:
- Glass bottles
- Illegal materials
- Weapons or firearms
- Pets (with exceptions made upon prior approval)
6.3 Guest Behaviour
Guests must behave in a respectful and considerate manner. Should a guest's actions create a safety hazard or disrupt the experience for others, we retain the right to terminate the charter prematurely without a refund.
7. Liability and Insurance
7.1 Limitation of Our Liability
We are only liable up to the amount paid for your charter. We are not responsible for:
- Injuries to individuals due to their own negligence
- Damage to personal belongings
- Indirect or punitive damages
- Delays influenced by weather or situations outside of our realm of influence
7.2 Insurance
Our operations and vessels are insured with comprehensive marine insurance. It is the passenger's responsibility to secure their own personal and travel insurance.
7.3 Acknowledgement of Risk
By partaking in our charter services, you recognize the inherent risks associated with marine activities and you agree to be accountable for your own health and safety.
8. Itinerary and Schedule Adjustments
We maintain the right to alter itineraries, paths, or schedules due to weather, safety considerations, or operational essentials. Every attempt will be made to ensure a similar quality of experience is provided.
9. Force Majeure
We shall not be held responsible for any deferrals, cancellations, or changes brought about by events outside of our control, such as but not limited to:
- Extreme weather conditions
- Natural catastrophes
- Governmental actions
- Port shut-downs
- Mechanical disruptions
10. Privacy and Data Protection
Your personal details are processed in line with our Privacy Policy. By engaging our services, you concur with our data collection and usage as described in the Privacy Policy.
11. Copyright and Trademarks
All material on our website, such as text, imagery, logos, and designs, is safeguarded by intellectual property laws. Reproduction, distribution, or creation of derivative works without our explicit permission is prohibited.
12. Jurisdiction
These Terms are under the jurisdiction of the appropriate laws in Monaco. Any legal proceedings shall be conducted in the courts situated in Monaco, Monaco.
13. Amendments to Terms
We reserve the right to alter these Terms whenever necessary. Such modifications will be publicized on our website with a notice of the date of revision. Ongoing utilization of our services signifies your agreement to the updated terms.
